  STANDARD
LABOR SAFETY "SECURING EMPLOYEES WITH RINSING AND (OR) DISABLING AGENTS"

1. The labor safety standard "Providing employees with washing and (or) neutralizing agents" (hereinafter - the Standard) establishes the rules for the acquisition, delivery, use and organization of storage of washing and (or) neutralizing agents.

2. The standard applies to employers - legal entities and individuals, regardless of their organizational and legal forms and forms of ownership.

3. The acquisition of flushing and (or) neutralizing agents is carried out at the expense of the employer.

4. Flushing and (or) neutralizing agents are divided into protective agents, cleaning agents and means of restoring, regenerating action.

5. Flushing and (or) neutralizing agents shall be provided to employees in accordance with standard standards for the free issuance of washing and (or) neutralizing agents to employees in accordance with Appendix No. 1 to this Order (hereinafter - the Standard Norms).

6. Flushing and (or) neutralizing agents that remained unused after the end of the reporting period (one month) can be used in the next month subject to their shelf life.

8. The issuance of flushing and (or) neutralizing agents to workers, including foreign production, is allowed only if they confirm compliance with state regulatory requirements by a declaration of conformity and (or) a certificate of conformity, drawn up in the manner established by applicable law.

Acquisition of flushing and (or) neutralizing agents that do not have a declaration of conformity and (or) a certificate of conformity or that have a declaration of conformity and (or) a certificate of conformity that have expired is not allowed.

9. The norms for the issuance of flushing and (or) neutralizing agents corresponding to the working conditions at the employee’s workplace are indicated in the employee’s employment contract.

10. When issuing flushing and (or) neutralizing agents, the employer must inform employees of the rules for their use.

11. The employee is obliged to use, as intended and in accordance with the Standard, flushing and (or) neutralizing agents issued to him in the prescribed manner.

12. The selection and delivery of flushing and (or) neutralizing agents is carried out taking into account the results of a special assessment of working conditions. (as amended by Order of the Ministry of Labor of the Russian Federation of February 20, 2014 No. 103n)

13. The list of jobs and the list of workers for which the issuance of flushing and (or) neutralizing agents is necessary is compiled by the labor protection service (labor protection specialist) or other authorized structural unit (official) of the employer and approved by the employer taking into account the opinion of the primary elected body trade union organization or other representative body authorized by employees.

The specified list of jobs and the list of workers are formed on the basis of the Model Norms and in accordance with the results of certification of jobs in terms of working conditions, taking into account the peculiarities of the existing technological process and organization of labor, raw materials and materials used.

Before the employer receives the results of certification of workplaces according to working conditions or if the employer does not have one, the list of workplaces and the list of workers for which it is necessary to issue flushing and (or) neutralizing agents are formed taking into account the opinion of the elected body of the primary trade union organization or another authorized employee representative body based on the Model Norms.

14. The issuance of flushing and (or) neutralizing agents to employees in accordance with the Model Norms is carried out by the authorized structural unit (official) of the employer.

15. Protective agents of hydrophilic, hydrophobic, as well as combined action (creams, emulsions, gels, sprays and others) are issued to employees when working with aggressive water-soluble, water-insoluble working materials, their alternating effects.

16. Means for protecting the skin under the negative influence of the environment (creams, gels, emulsions and others) are issued to employees engaged in outdoor and other work related to exposure to ultraviolet radiation in the ranges A, B, C, high and low temperatures, wind and other .

17. Means for protection against bacteriological harmful factors that have an antibacterial effect are issued to workers employed in industries with increased requirements for the sterility of their hands, when working with bacterially hazardous environments, and also when finding a workplace remotely from stationary sanitary facilities.

18. Means for protection against biological harmful factors (insects, arachnids) are issued to workers when working in areas where seasonally observed mass years of blood-sucking and stinging insects (mosquitoes, midges, horseflies, gadflies and others), as well as the spread and activity of blood-sucking arachnids ( ixodid ticks and others), taking into account the seasonal specifics of the region.

19. The use of protective equipment specified in paragraphs 14 to 18 of the Standard is carried out by applying it to exposed areas of the body before starting work.

20. In work related to easily washed away contaminants, for use in showers or washrooms, workers are given cleaning products in the form of solid toilet soap or liquid detergents (hand gel, body and hair gel, liquid toilet soap and others).

In works related to easily washed away contaminants, the employer has the right not to give out washing products directly to the employee, but ensures the constant availability of soap or dispensers with liquid washing substance in sanitary premises.

To cleanse face skin contamination, workers are given only slightly alkaline varieties of soap (toilet).

Replacement of soap or liquid detergents with skin-aggressive products (organic solvents, abrasive substances (sand, cleaning powders, etc.), caustic soda and others) is not allowed.

21. In works related to difficult to wash off, persistent pollution (oils, greases, soot, oil products, varnishes, paints, including printing, resins, glues, bitumen, silicone, graphite, various types of industrial dust, including coal, metal etc.), in addition to solid toilet soap or liquid detergents, workers are given cleansing creams, gels and pastes.

Replacing these cleaning products with solid toilet soap or liquid detergents is not permitted.

22. When working with aggressive water-soluble, water-insoluble and combined substances and the negative impact of the environment (external and other works associated with exposure to ultraviolet radiation of ranges A, B, C, exposure to elevated or low temperatures, wind), workers are given regenerative (restoring) agents (creams, emulsions and others) according to the Model Standards. The use of these funds is carried out by applying them to open clean areas of the body after work.

23. The issuance of liquid washing and (or) neutralizing agents to the employees, packaged in packages with a capacity of more than 250 ml, can be carried out through the use of metering systems that are located in sanitary facilities. Replenishment or replacement of containers containing flushing and (or) neutralizing agents is carried out as these funds are spent.

24. The employer is obliged to organize proper accounting and control over the issuance of flushing and (or) neutralizing agents to employees on time.

The terms of use of flushing and (or) neutralizing agents are calculated from the date of their actual delivery to employees and should not exceed the expiration dates specified by the manufacturer.

The issuance of flushing and (or) neutralizing agents to employees should be recorded against the signature in the personal record card of the issuing of flushing and (or) neutralizing agents, a sample of which is provided for in the Appendix to the Standard.

25. The employer shall store the flushing and (or) neutralizing agents issued to employees in accordance with the manufacturer's recommendations.

In what cases you need to have a personal accounting card

Maintaining cards, as well as an indication of the employment contract, is mandatory for all employers. Otherwise, the inspector may fine the organization for the first part for non-compliance with the requirements of paragraph 24 of the labor safety standard “Providing workers with flushing and (or) neutralizing agents”, approved

The form of the card is approved, therefore it is prohibited to make changes to the form. The card is started when an employee is hired.

What should be recorded in the LC and how to fill it in correctly

The LC should be filled out by the warehouse employee or the head of the structural unit, and the labor protection specialist should check the correctness of the entries.

Personal card consists of front and back. In order to fill it out correctly, the head of a structural unit or a warehouse employee must request from the personnel management service the data necessary to indicate the required details on the front side.

Try not to make mistakes. In case of an error, do not cover up the data with the corrector, cross out the line and write the correct value above it.

The card needs to be numbered. The numbering is done according to the accounting rules, and if the card is issued by the structural unit, and not by the parent company, the number can be compiled arbitrarily, in accordance with the adopted document management system.

The front part is filled with data about employees. Name must be indicated fully in the nominative case. Patronymic is entered only if it is in the employee's passport. For foreign workers, including citizens of Ukraine, the patronymic is not indicated in the passport. The personnel number is filled in according to personnel records. Usually it is put down in the timesheet.

The name of the structural unit is also indicated by personnel data. In the column "Profession, position" it is necessary to enter data on the main place of work. start a separate LC.

Be sure to put down the date of employment. If the employee was transferred to another department or workshop, then the date of this event is recorded in a separate column, and it is not forbidden to enter the order number. Dates are filled in the format DD.MM.YYYY, for example, 05/17/2019.

Then the main part of the card begins in the form of a table. It should be noted that according to which section (Roman numerals) and according to which clause (Arabic numerals) of Norms No. 1122n, the issuance of C&S is carried out, indicate their type, unit of measurement (if liquid means ml, if solid soap - g).

Then, in the front part of the LC, the amount for the year is filled. To do this, you need to multiply the monthly norm, approved in the standard for issuance No. 1122n, by 12 months. The trade name of the funds is not required to be indicated, because both the supplier and the brand of the product used may change. Thus, the planned number of issued S&I is established.

Record Example:

At the bottom of the front side of the card, the signature of the head of the structural unit is required. A labor protection specialist, accountant or storekeeper should not sign the card.

Signing a card is allowed only to the head of the structural unit - the workshop, section or department.

The back of the personal card serves to confirm the completeness and timeliness of the issue by the employee. There are records of the actual disbursement of funds.

Until June 12, 2018, easily washable S&P must also be entered on a personal card. After this date, it is permitted not to deposit easily washed-out funds in a personal card and in an employment contract. In the meantime, it is not allowed to do this only in one case - if not specified in the List of free issuance of flushing and (or) neutralizing agents and the standard of labor safety. For example, for hygiene needs (in the office).

On the back of the personal card, indicate in the first column the type of environmental protection system, then the data from the certificate of compliance. In the “Issued” field, enter the date of actual issuance in the DD.MM.YYYY format, the amount of funds disbursed, as well as the method of issue — either in the dispenser or in person. In the last column is the employee's signature on receipt, which should only be handwritten.

In the standard No. 1122n there is no indication of maintaining a card purely in paper form. Consequently, the employer has the right to keep cards electronically. The employee can either - in the primary accounting document (for example, in the demand invoice), and the number of this invoice will be indicated on the personal card. The fact that the employee has a signature on receipt in this case will be undeniable. What is not prohibited in a regulatory legal document cannot be a reason for bringing to administrative responsibility.

There is a minus to the electronic signature - its cost, and the indication on the personal card number of the primary accounting document can raise unnecessary questions of the inspecting authority. Therefore, it is still more convenient to keep the card traditionally, especially since in a month it will no longer be necessary to indicate easily washed off funds in it. This is a less risky option.

Great news for labor protection specialists - the issuance of certain washing-up products to employees will not be fixed for signature. Changes will affect the issuance of soap or liquid detergents, including for washing hands and body, during work associated with easily washed dirt.

The order of the Ministry of Labor has already been approved, will enter into force 6 months after official publication - June 12, 2018. As you can see, the Ministry of Labor has fulfilled one of the points of the action plan for the abolition and updating of mandatory requirements in the field of compliance with labor laws and other legal acts containing labor law norms.

Amendments are made to Appendix No. 2 to the order of the Ministry of Health and Social Development of the Russian Federation of December 17, 2010 N 1122n "On the approval of standard norms for the free issuance of flushing and (or) neutralizing agents to workers and the standard for labor safety" Providing workers with flushing and (or) with neutralizing agents "- in clause 9 and clause 24 of the labor safety standard.

In the current version, clause 9 reads as follows: “The standards for the issuance of flushing and (or) neutralizing agents corresponding to the working conditions at the employee’s workplace are indicated in the employee’s employment contract."

From June 12, 2018, the wording will be as follows: “The standards for the issuance of flushing and (or) neutralizing agents corresponding to the working conditions at the employee’s workplace are indicated in the employee’s employment contract or in the local regulatory act of the employer, are communicated to the employee in writing or electronically in a way that allows you to confirm that the employee is familiar with these standards».

Clause 24 regulates the organization of accounting and control over the issuance of flushing and neutralizing agents to employees, as well as sets the terms for their use and the procedure for issuing them. The third paragraph of this paragraph, which reads as follows: “The issuance of flushing and (or) neutralizing agents to employees shall be recorded against the signature on the personal registration card of the issuing of flushing and (or) neutralizing agents, a sample of which is provided for in the Appendix to the Standard,” has been amended. After the words "Issue to employees of washing and (or) neutralizing agents" added “with the exception of the funds referred to in paragraph 7 of the Model Standards”. In paragraph 7 of the Model Norms provided for in Appendix No. 1, cleaning agents for easily washed away contaminants of the hands and body (soap or liquid detergents) are included.

By the way, labor protection experts often ask the question: what is meant by “easily washed away pollution” and workers, what professions and positions they encounter?

The very definition of the term “easily washed away pollution” is absent in any legal acts. However, in the explanations of departments there is an interpretation of this concept. For example, the Department of Conditions and Labor Protection in a letter to the Ministry of Labor dated June 23, 2016 No. 15-2 / В-2039 “On the Procedure for the Issue of Flushing and (or) Decontaminating Agents to Employees” referred to easily washed off contaminations such contaminants in which the use of soap or liquid Detergents are sufficient to cleanse the worker from skin and hair during work. It is possible to exclude from the norms of extradition workers who operate a personal computer and desktop copying machines (“office” workers).

Also, to determine the list of professions to be disbursed, labor protection specialists can use the “Recommendations on the use of washing and neutralizing agents for employees of the main professions of structural divisions of Russian Railways”, Appendix No. 2 of which provides an approximate list of professions with recommended washing and neutralizing agents .

The amendments introduced will exclude disputes on the issue of accounting and issuance of detergents, which are located directly in the sanitary facilities. However, the issuance of solid soap and liquid detergents to eliminate difficult to wash out contaminants, however, like the other 8 types of washing and neutralizing agents, it will be done under painting.

The employer is obliged to provide safe conditions and labor protection (Articles 212, 221 of the Labor Code of the Russian Federation). In particular, if workers work in harmful, hazardous or special temperature conditions or perform work related to pollution, the employer must give them personal protective equipment, as well as flushing and (or) neutralizing agents. The employer purchases the indicated funds (having passed mandatory certification or declaration of conformity) at his own expense and gives it out to employees in accordance with standard standards.

By order of the Ministry of Health and Social Development of Russia dated December 17, 2010 No. 1122n, new standard standards for the free issuance of flushing and (or) neutralizing agents to employees were approved. Compared with the old standards (approved by Decree of the Ministry of Labor of the Russian Federation No. 45 of 04.07.2003), the list of such funds has been increased. In addition, they are now divided into three subgroups: protective, cleansing, as well as restorative and regenerative effects. It is written in more detail what works and production factors imply the issuance of flushing and (or) neutralizing agents. So, employees engaged in outdoor work during the season of activity of blood-sucking and stinging insects will be provided with the issuance of appropriate protective equipment.

The employer provides workers with flushing and neutralizing agents in accordance with the labor safety standard approved by the Order under consideration (hereinafter - the Standard). This Standard is required to comply with all legal entities and individuals, regardless of legal forms of ownership and ownership (Clause 3 of the Standard). Employers, taking into account the views of the trade union, have the right to determine their own higher standards (paragraph 7 of the Standard, by analogy with part 2 of article 221 of the Labor Code of the Russian Federation). At the same time, the norms for issuing flushing and neutralizing agents should be indicated in the employee's employment contract (paragraph 9 of the Standard).

The list of jobs and the list of workers for which the selection and delivery of such funds are necessary are formed according to standard standards and the results of certification of jobs according to working conditions (the latter is carried out in the Procedure approved by Order of the Ministry of Health and Social Development of the Russian Federation of August 31, 2007 N 569). The specified list and list is compiled by the labor protection service (labor protection specialist) and approved by the employer taking into account the views of the trade union (paragraph 13 of the Standard).

The issuance of funds is recorded under the signature of the employee in his personal accounting card. It should be noted that if the work involves easily washed away contaminants, the employer may not give out flushing agents directly to the employee, but rather ensure that there are soap or dispensers with liquid flushing agent in sanitary premises.

For employees engaged in one-time work with difficult-to-wash substances or at non-standard temperatures, and for those who work part-time, the norms of DIZE are determined by the real time of the influence of the hazardous factor.

3. Ordering for the issuance of flushing and neutralizing agents.

Issue of soap for labor protection

The employer independently, focusing on the results of the SUT, draws up a list of persons receiving DTI.

However (liquid or toilet) should be used by all workers. This is an elementary hygiene requirement.

But the law does not specify this requirement separately anywhere, and in the letter of Rosstroda No. 15-2 / OOG-1752 dated 05/05/2016, it was confirmed that there is no need for personnel engaged in office work (such as accounting work, for example).

At the same time, do not forget about the fines for the absence of a remand center (part 3 of article 5.27 of the Code of Administrative Offenses).

They amount to rather large amounts: individual entrepreneurs without a legal entity will pay a fine of 5 to 10,000 rubles. Officers will be punished in the amount of 10 to 20,000 p. The penalty for organizations is even more serious: from 50 to 100,000 rubles.

Soap must not be replaced with aggressive and abrasive cleaners (soda, cleaning powder, solvents, etc.)
