1. Filling in the details of the organization

If the legal address of the organization does not coincide with the actual location of the outlet. You must add a standalone unit. To do this, go to the "Separate division" section and click "Add", enter the abbreviated name of the organization, address and note (!) Enter the checkpoint corresponding to this address.


If you have a license for the retail sale of alcohol, in the "Licenses" section, click on the "Add" button and fill in the data in accordance with your license, in the column "Type of activity" we indicate "Retail sale of alcoholic products".


Filling in the details of counterparties (manufacturers and suppliers).

Before filling out the declaration, it is necessary to fill out directories containing the requisites of your suppliers and manufacturers. To do this, go to the "Counterparties" section. And click "Add."

Enter data on the legal entity. Select the checkbox "Legal entity" and "Manufacturer / importer", enter the details and click "OK."


Enter the data for the individual. Select the checkbox "Person." And "Manufacturer / Importer", enter the details and click "OK."

We enter data on the Foreign Organization. Select the checkbox "Foreign." and "Manufacturer / importer", to the section "Country Code" indicate "112", enter the details and click "OK".

If you need to enter a license for your supplier. In this case, it is necessary to select the desired supplier and click "Add" in the "Licenses" section and fill out the data on the supplier’s license, in the column "Type of activity" indicate "Purchase, storage and delivery of alcoholic beverages".


Filling out a declaration on alcohol and beer.

We go to the section "Work with declarations" and click on "Add", in the window that opens, select the desired declaration form (11 form - alcohol declaration) (12 form - beer declaration), fill out the full name of the Subject of the Russian Federation that issued the declaration, the reporting period and not forget to put (!) a checkmark in the list of licenses and click "OK".


Select the desired declaration and click "Change."


In the opened declaration, select in "Table No. 1", then select the desired outlet.


We begin to fill in the position on arrival. Choose a product code. The right manufacturer, supplier and its license. Fill in the date, number of the waybill and the number of decalitres and click on the "Add" button, if you need to change or delete the position, press the "Add", "Change" button.


After all the positions for all retail outlets are clogged up, go to "Table No. 1", select a sales outlet and click "Import Residues" to import the balances of the previous period, select the desired declaration for the previous reporting period in the window that opens and click "OK" .


After the balances are imported, we recalculate the declaration by clicking on the "Import Purchases from Table No. 2" button, we do these actions for each department separately.


After recalculation of the declaration, fill in the data on the receipt, sale and return of products. (!) Pay attention to the column "total purchases", it should be equal to either the column "receipt from manufacturers" or "receipt from wholesalers" until you fill out one of these columns, the line will turn white.


After the declaration is full it can be viewed by clicking on the "Print" button, there you can still upload to .xls and.pdf. To submit the declaration, we need an XML format, in order to unload the declaration, click "Unload" and select the place of unloading.

Since beer alcoholism is developing rapidly, the authorities have adopted restrictions related to the sale of this product. It is forbidden to sell hop products in the territories around:

  • school and preschool institutions (kindergartens, schools);
  • honey. objects;
  • sports complexes;
  • cultural objects (museums, theaters, etc.);
  • gas stations;
  • crowded places (station, bus station, airport);
  • military units;
  • public transport stops.

Trade in beer for entrepreneurs should be carried out in capital construction buildings with a foundation. In addition, the shopping facility must be executed in accordance with Russian law and entered into the real estate register.

Beer declaration (form 12): form and sample

If in the current reporting period there are facts of non-reflection or incompleteness of reflection of the necessary information in the declaration, as well as errors (distortions) made in the expired reporting period, the organization (individual entrepreneur) submits corrective declarations containing information (additions), clarifying the information contained in the declarations submitted earlier. Corrective declarations are submitted before the end of the reporting year with a justification of the reasons that caused the incompleteness or inaccuracy of the submitted information (with the exception of the submission of corrective declarations by order of the licensing authority to eliminate violations of the license terms) (paragraph

How to fill out a beer and alcohol declaration

The latest versions of the program 1C 8.3 "Retail" contain mechanisms to fully interact with the EGAIS system. Accordingly, the program database stores all the data for declaring its activities.

But, unfortunately, it is not possible to generate and send the declaration itself electronically. The program provides only the opportunity to create a "Journal of accounting the volume of retail sales of alcoholic and alcohol-containing products."


This journal reflects all the necessary information for filing an alcohol declaration. Regarding the license for the right to sell beer, in 2019 for IP it will not be required yet. This information is enshrined in law. 18 No. 171-FZ. Confirmation of the sale of each bottle of beer is not required, as is the case with strong alcoholic drinks. It is enough to provide information about the legality of the consignment of goods received. For beer and beer products, a declaration of form 12 applies.

The form requires filling in the following information:

  2. Information about the manufacturers.

EGAIS is a specialized tool for exercising state control over the manufacture, sale and use of alcohol-containing products on the territory of the Russian Federation.

There are a number of entities that have the right not to connect to the system to submit a report on beer 2019 for control:

EGAIS for beer also requires the introduction of information on each counterparty manually, this is due to the fact that the beer product does not have to be licensed yet, and the registry, accordingly, cannot be automatically generated.

Limitations

Responsibility of an individual entrepreneur

In the summer of 2017, amendments to the Code of Administrative Offenses were introduced, providing for strict liability in identifying violations associated with the illegal sale of alcoholic beverages.

Retail beer in 2019 provides for the following items:

  1. The time allowed for the sale of alcoholic beverages is valid from 8 to 23 hours. The penalty for violation for the seller will be from 30,000 to 50,000 rubles, the store owner risks giving away an amount from 5,000 to 10,000 rubles. An individual entrepreneur or legal entity, in addition to a fine of up to 100,000 rubles, may be confiscated.
  2. A place to trade. It is forbidden to sell alcoholic drinks, alcoholic energy near schools, kindergartens, sports sections, as well as in kiosks or stalls. The facility must comply with capital construction standards. For non-compliance with these rules when conducting business, an entrepreneur runs the risk of paying from 10,000 to 15,000 rubles, and an organization represented by a legal entity up to 300,000 rubles.
  3. For reporting to EGAIS with errors in the volume, production or turnover of finished products of the alcohol type, an individual will pay from 5,000 to 15,000 rubles, and a legal entity from 150,000 to 200,000 rubles.
  4. The absence of a cash desk for entrepreneurs and business owners will cost a fine of 25 to 50% of revenue (at least 10 thousand rubles), and a legal entity may part with an amount of 75 to 100% (at least 30 thousand rubles) .
  5. Keeping a daily sales journal. If incorrectly filled, the fine will be from 10,000 to 15,000 rubles for individual entrepreneurs and from 150,000 to 200,000 for the organization.
  6. It is forbidden to sell beer in plastic containers with a volume exceeding 1.5 liters. The fine for an individual entrepreneur will be from 100,000 to 200,000 rubles, for a legal entity up to 500,000 rubles.

In case of illegal trade in alcohol through an individual, a fine of 30,000 to 50,000 rubles is foreseen.

To summarize. All entrepreneurs engaged in retail beer trading are required to report on the volume of purchases, and submit a beer declaration (form 12).

Individual entrepreneurs using the UTII taxation regime or a patent and not having hired employees can conduct their business without using an online cash register when selling until the summer of 2019. The deferral is determined by federal law on the CCV.

Since there are constantly changes in the legislative framework related to regular amendments to the terms of use of online cash registers, it is worthwhile to periodically consult with employees of the Federal Tax Service in your territorial unit. This will protect against unreasonable fines and warnings in the future on their part.

Considerable fines are provided for violation of administrative discipline in the sale of beer and drinks based on it, the amounts of which vary from 2,000 to 500,000 rubles.

Taxes for individual entrepreneurs and organizations on alcohol products are not yet planned to be introduced. So far, consideration of this issue has been postponed to 2020.

Economic entities that have received a license to carry out production, trade or transport operations related to alcohol and beer are required to declare the results of their activities to the FSRAR. This body is engaged in state control and regulation of alcohol turnover in the Russian Federation. We consider in the article what an alcohol declaration is, how it is completed in steps, and in what time frames it is submitted.

The declaration does not contain data on the income or profits of companies involved in the production or sale of alcoholic beverages, it shows information on the turnover of products, their production and movement.

Alcohol declaration forms

The declaration is filed by persons whose work is associated with:

  • Production of suitable products;
  • By transportation;
  • Storage;
  • The implementation of wholesale and retail.

Such persons include organizations, individual entrepreneurs and other persons, for example, citizens who grow grapes to create wine in the framework of private farms.

For each of these categories of persons, the declaration form will be different. In addition, the form depends on the type of product with which the declarant interacts. A separate form is provided for individual entrepreneurs. Decision 815 of 08/09/12 as amended. from 05/13/16 determines the procedure for filing declarations on the use, production, circulation of alcohol and other products and enters into force the relevant Rules with the forms of declarations.

Where to file your alcohol declaration?

Place of declaration of information on alcohol activity:

  • Regional authority regulating these issues;
  • FSRAR.

All reports to the FSRAR are submitted only in electronic format, while the above data are certified by UKEP. A person who has received a license to conduct operations with alcoholic beverages should also issue this electronic signature, which will comply with the requirements of the Federal Service for the Control of Political Development and install the necessary software for electronic exchange of documents. You also need to register on the website of the authority from which the license was obtained. After the preparation of the declaration, it is certified by UKEP, after which the file is sent through the personal account.

An exception is made for the declaration of the amount of grapes harvested used for the production of wine, which can be submitted in paper format if it is not possible to file it electronically. Declarations submitted to local authorities may also be made available in paper form if such a format is available in the region.

Delivery deadlines:

  • Quarterly within 20 days from the end of the quarter - for declarations from appendices 1-12 to the rules;
  • Once a year until February 15, inclusive, for the year in which the grapes used in the production of wine products are harvested - for declarations from appendices 13-15.

Place for filing alcohol returns

  • In FSRAR - all declarations, with the exception of those presented in appendices 11, 12 13. These reports are filled out as a whole by the organization or agricultural producer;
  • To the executive body of local authorities involved in alcohol and alcohol control (the specific name of the authority is specified in the region) - declarations from appendices 11 and 12 on retail sales volumes (at the place of registration of the legal entity or individual entrepreneur), and from appendix 13 (at the place of registration of the agricultural producer, organization or citizen leading private household plots). Also, copies of these reports are submitted to the FSRAR within 24 hours after their transfer to the local authority.

When submitting incorrectly completed declarations, with incomplete reflection of all necessary data or making errors in the indicated indicators, corrective declarations for the same period should be submitted.

Verification of alcohol declarations

The RAR declarations are submitted electronically, which allows you to verify the data shown by manufacturers, suppliers and buyers. Thanks to this, control over the created and consumed alcoholic products in the country is carried out. Such reconciliations reveal discrepancies in performance, which ultimately leads to official inspections of companies working with alcohol and suspension of business and selection of licenses.

RAP uses special automated programs that check procurement and supply data. Failure to check is an occasion to send the relevant letters to both participants of the process (supplier and buyer).

So that such discrepancies are not detected, and declarations are checked by the PAP and accepted by them, monthly indicators should be checked with their counterparties.

Beer Retail Declaration

When trading beer in retail, information about their volumes should be reported by filling out a declaration from Appendix 12 to Government Decision No. 815. This report is also filled in when selling cider, mead, poire, beer drinks.

If, in addition to beer, the retail sale of strong alcoholic drinks is carried out, then you will have to additionally fill out the declaration from Appendix 11 to the said resolution. The legal declaration on beer is served by legal entities and entrepreneurs who sell these drinks at retail. This also includes cafes, restaurants, kiosks, retail outlets.

The declaration should be submitted to the local authority involved in the control of alcohol turnover, the name of this body is being specified in your region. In addition, within the next day after sending the declaration, the local authorities need to provide an electronic copy of it to the FSRAR.

The deadline for submission is the 20th day of the month for the reporting quarter. However, it is better to perform this procedure in advance in order to have time to receive a response on the acceptance of the report.

If there was no trade during the whole quarter, then you still have to submit a declaration. In the lines to indicate implementation data, zeros are not set, the lines remain empty. Information about the remains of beer and beer drinks is transferred to the beginning of the quarter.
